Imports of specialty creams , namely sterilized creams, minimum 23% butterfat, in cans of a volume not exceeding 200 ml., are subject to import controls under Canada’s Export and Import Permits Act (EIPA). Accordingly, an import permit is required for shipments of specialty creams to enter Canada. Import permits for shipments of specialty creams destined to the Canadian market are issued to allocation holders under Canada’s tariff rate quota (TRQ) for specialty creams, which is administered by Foreign Affairs, Trade and Development Canada (DFATD). The access quantity for the specialty creams TRQ is 394,000 kg. The allocation period for the specialty creams TRQ extends from August 1 to July 31, inclusive. This Notice to Importers sets out the policies and practices pertaining to the administration of the TRQ, including the allocation, under-utilization, return, and transfer policies. This Notice also explains how to apply for import permits.

1.1 This Notice supersedes Notice to Importers No. 520 dated November 27, 1995; it refers to item 140 of the Import Control List. 1.1 The purposes of this Notice are: a. To inform importers of the Ministers policies and practices respecting the administration of the 3,274,000 kilogram tariff rate quota (TRQ) for butter, dairy spreads, and fats and oils derived from milk, other than butter or dairy spreads. It should be read with the Import Allocation Regulations and the Import Permit Regulations. Where elements of the present Notice augment these Regulations, those elements are to be read as expressions of the Minister's normal practices and procedures; and b. To inform importers that the TRQ for butter, dairy spreads, and fats and oils derived from milk, other than butter or dairy spreads for the 2013-2014 marketing year has been entirely allocated to the Canadian Dairy Commission (CDC).
