Overlay and Interim Zoning
Overlay zoning districts are designed to require special controls in certain areas of the City that have special characteristics or special development issues. The intent of an overlay zoning district is to provide common controls over areas that require a specific type of zoning control but are typically zoned with more than one (1) base zoning district. Unless modified by the overlay zoning district regulations, the regulations of the base zoning district apply. Whenever a lot and/or development site, as defined below, is covered by more than one overlay zoning district, the regulations of each overlay zoning district shall apply, except that where the regulations of such overlay zoning districts contain an actual, implied or apparent conflict, the more restrictive regulation shall apply unless stated otherwise.

The purpose of Planned Area Development Overlay Districts is to accommodate, encourage and promote innovatively designed developments involving residential and/or non-residential land uses, which form an attractive and harmonious unit of the community. Such a planned development may be designed as a large-scale separate entity, able to function as an individual community, neighborhood, or mixed-use development; as a small-scale project which requires flexibility because of unique circumstances or design characteristics; or as a transitional area between dissimilar land uses.

The Territory Plan is the key statutory planning document in the ACT, providing the policy framework for the administration of planning in the ACT. The Territory Plan guides the planning and development of the ACT. It is changed from time to time due to social, economic and environmental reasons. The Territory Plan is used to manage development, in particular the way in which land is used and what can be built. It is used in the process of assessing development applications and to guide the development of new estate areas (future urban land). Land in the ACT is divided into sections and blocks. The blocks are zoned and the zoning determines the form of development on a block. There are 23 different zones. The Territory Plan map shows all these zones as different colours. The purpose of the Territory Plan map is to show the zones and overlays that apply to land in the ACT, in accordance with requirements under the Planning and Development Act 2007.
