SFEC Departmental Gifts Disclosure Cover Page
A. SUMMARY Section 3.217 of the Campaign and Governmental Conduct Code requires each Department Head to disclose payments that their department receives from a source that is not a federal, state, or local government and for which the department does not provide equal or greater consideration. Each department accepting gifts will disclose all gifts received during the calendar month from a source that is not a federal, state, or local government. Departments will be expected to submit one disclosure form covering all gifts received in the preceding calendar month, when applicable. This dataset provides an overview of each department filing, such as the total number of gifts and gift value, filing period, and amendments. HOW THE DATASET IS CREATED Data for this dataset is created when departments file the gifts disclosure form provided by the Ethics Commission, starting in December 2024. This form is due within 15 calendar days after the end of the month the department received the gift(s). If a department has not received any gifts in a given month, no filing is necessary. C. UPDATE PROCESS The dataset is updated via the Socrata Publisher API as needed when form filings are submitted and signed by city departments. D. HOW TO USE THIS DATASET The unique row identifier for this dataset is “Envelope Id”. Individual filings from departments can be identified by the columns Filing Month, Filing Year, and DepartmentNameLookup. Amendment filings can be identified by the column TypeOfFiling. E. SFEC Form 124 - Contributions Made by Business Entities - Contracts and Grants

Under San Francisco Campaign & Governmental Conduct Code Section 1.124, any committee required to file campaign statements with the Ethics Commission must disclose certain additional information no later than the deadline for filing semi-annual or pre-election statements any contribution(s) that, in the aggregate, total $10,000 or more from a single business entity in a single election cycle. For the purposes of this disclosure, the committee must disclose one of the business entity’s principal officers, including but not limited to the Chair of the Board of Directors, President, Vice President, CEO, CFO, COO, Executive Director, Deputy Director, or equivalent positions. The committee must also disclose whether, within the 24 months prior to the date the entity’s contributions to the committee totaled $10,000 or more, the business entity received funds through a contract or grant from any City agency for a project within the jurisdiction of the City and County of San Francisco. Under San Francisco Campaign & Governmental Conduct Code Section 1.114.5(b)(2), any ballot measure committee or committee making independent expenditures that receives contributions totaling $5,000 or more in a calendar year at the behest of a City elective officer shall file Form 114.5. “At the behest of” means under the control or at the direction of, in cooperation, consultation, coordination, or concert with, at the request or suggestion of, or with the express, prior consent of. However, a contribution is not made at the behest of a public official solely because the official requested the contribution via television, radio, billboard, a public message on an online platform, the distribution of 200 or more identical pieces of printed material, the distribution of a single email to 200 or more recipients, or a speech to a group of 20 or more individuals. The committee must file Form 114.5 no later than the deadline to file the semi-annual or pre-election campaign statement that must report the contribution that makes the cumulative total $5,000 or more. For current filings, see dataset https://data.sfgov.org/City-Management-and-Ethics/Gifts-Of-Travel/snqf-y894 Under section 3.216(d) of the San Francisco Campaign and Governmental Conduct Code, form SFEC-3.216(d) must be filed by an elected officer who either:(a) accepts a gift of transportation, lodging, or subsistence for any out-of-state travel that is paid for in part by an entity other than the City and County of San Francisco, another governmental body, or a bona-fide educational institution as defined in section 203 of the Revenue and Taxation Code, or that is paid for by the City in whole or in part with funds donated from any entity other than another governmental body or bona fide educational institution as defined in Section 203 of the Revenue and Taxation Code; or(b) reimburses the entity for the gift of transportation, lodging or subsistence in order to avoid receiving a gift.
