ACIntel - EPA Agreements Public Register
Environmental protection agreements are formal agreements under the Environment Protection Act 1997, between the Environment Protection Authority (EPA) and people conducting certain activities that pose environmental risks. Environmental protection agreements allow scope for businesses to manage their environmental performance in partnership with the EPA rather than the EPA acting solely as enforcer.

Under the Environment Protection Act 1997 (Section 41A), it is a requirement that certain activities that pose environmental risk call for an Environmental Authorisation. Environmental Authorisations are one of the most important regulatory tools available to the EPA, as they set out conditions for activities carrying with them the greatest environmental risk. Each authorisation can be individually tailored for the activity it authorises, and can impose specific conditions on the conduct of the activity.

This data includes information from the EPA public register index, but might not include the latest information available. The Water Resources Act 2007 (the Act) regulates the taking of surface water and groundwater. Surface water means water from sources such as rivers, lakes, ponds, the stormwater system or other overland flow. Groundwater usually refers to bore water from underground aquifers. The Act is administered by the Environment Protection Authority.

This layer shows sites currently regulated by EPA Tasmania under the Environmental Management and Pollution Control Act 1994 (EMPCA). Active legal instruments containing EPA Tasmania requirements relating to the premises are provided. These documents include Permit Conditions Environmental (PCEs), Environment Protection Notices (EPNs), Site Management Notices (SMNs), Remediation Notices (RNs), Investigation Notices (INs) and Environmental Licences (ELs). Permits issued by planning authorities are not shown but may be obtained by contacting the relevant Council. Permits issued under previous legislation are only displayed (as PCEs) when they have not been subsequently varied by an EPN. The spatial location for each site is represented by a single point, which has been selected to best represent the location of the regulated activity. Because of the broad and sometimes fragmented nature of some activities, the displayed location will not show the full extent of the activity. Data is auto-updated daily from EPA's regulatory database. EPA Tasmania welcomes feedback on the content of this layer.

EPA maintains a searchable list of properties issued with a certificate or statement of environmental audit in accordance with sections 53V and 53X of the Environment Protection Act. A certificate of environmental audit is issued for a property where, following an audit, an environmental auditor believes the environmental condition of the land is suitable for any beneficial use.

The Planning and Development Act 2007 requires the Environment Protection Authority (EPA) to keep a register of contaminated sites. Sites are included on the register if the EPA requests a review of an assessment of contaminated land by an approved contaminated land auditor or they have received notification of the need for an audit from an approved auditor.
