Oceans Act Areas of Interest
The selection of an Area of Interest (AOI) marks the beginning of the Oceans Act Marine Protected Area (MPA) establishment process led by Fisheries and Oceans Canada. The process includes completing detailed ecological and socioeconomic assessments, setting conservation objectives, determining boundaries and management measures, and eventually developing the regulations under section 35 of the Oceans Act. Collaboration, consultation, and engagement occurs with stakeholders and partners throughout each step of this process.

The Oceans Act (1997) commits Canada to maintaining biological diversity and productivity in the marine environment. A key component of this is to identify areas that are considered ecologically or biologically significant. Fisheries and Oceans Canada (DFO) Science has developed guidance on the identification of Ecologically or Biologically Significant Areas (EBSAs) (DFO 2004) and has endorsed the scientific criteria of the Convention on Biological Diversity (CBD) for identifying ecologically or biologically significant marine areas as defined in Annex I of Decision IX/20 of its 9th Conference of Parties. These criteria were applied to the Newfoundland and Labrador (NL) Shelves Bioregion in two separate data-driven processes. The first process focused on the area north of the Placentia Bay-Grand Banks (PBGB) Large Ocean Management Area (LOMA) (DFO 2013). The second process focused on the PBGB area (DFO 2019), where EBSAs had previously been identified using a more Delphic approach (Templeman 2007). In both cases, an EBSA Steering Committee, comprised of experts in oceanography, ecosystem structure and function, taxa-specific life histories and Geographic Information Systems (GIS) guided the process by advising or aiding in the identification, collection, processing and analysis of data layers, as well as participating in the final selection of candidate EBSAs (Wells et al. 2017, Ollerhead et al. 2017, Wells et al. 2019). All information was compiled in a GIS and a hierarchical approach was used to review individual data layers and groupings of data layers. Peer review meetings were held for both processes, during which candidate EBSAs were reviewed and the final EBSAs were agreed upon and delineated. In the northern study area, a total of fifteen EBSAs were identified and described; three of these areas are primarily coastal areas; seven are in offshore areas; four EBSAs straddle coastal and offshore areas; and one is a transitory EBSA that follows the southern extent of pack ice. In the PBGB study area, fourteen EBSAs were identified in two different categories: seven based on coastal data and seven based on offshore data. In comparing the new PBGB EBSAs to those identified in 2007, nine of them overlap spatially and are based on similar features; however, there were some variations in the boundaries. Two of the EBSAs that were identified in 2007 were no longer considered EBSAs in 2017, but portions of both of these areas were captured in part by other EBSAs. Baseline oceanographic records for the Eastern Shore Islands Area of Interest

The Eastern Shore Islands was announced as an "Area of Interest" (AOI) in 2018 by the DFO Maritimes region to potentially be considered for a Marine Protected Area under the federal Oceans Act. As part of its mandate for monitoring established and potential conservation areas, DFO Science regularly deploys instruments including conductivity/temperature/depth (CTD) loggers, and other instruments for measuring dissolved oxygen, nutrients, and other chemical ocean properties. This data collection includes temperature and other oceanographic records for the ESI AOI from June 2024 onward. The data are derived from temperature loggers (Hobo Tidbit loggers or similar) and Sea-Bird MicroCATs, but may in future years include current profiles or additional oceanographic data. These data will be used to monitor temperatures in this coastal region to detect any biological shifts associated with temperature and climate fluctuations, and be used to groundtruth oceanographic models. FAO Major Fishing Areas for Statistical Purposes are arbitrary areas, the boundaries of which were determined in consultation with international fishery agencies on various considerations, including (i) the boundary of natural regions and the natural divisions of oceans and seas; (ii) the boundaries of adjacent statistical fisheries bodies already established in inter-governmental conventions and treaties; (iii) existing national practices; (iv) national boundaries; (v) the longitude and latitude grid system; (vi) the distribution of the aquatic fauna; and (vii) the distribution of the resources and the environmental conditions within an area. For various historical reasons the Areas in the Pacific were not so developed, with the exception of Area 87 corresponding to the CPPS area of competence. Initiatives for closer cooperation between agencies in the interest of better data, not only in the field of tunas, have suggested that some changes are necessary to the present FAO fishing areas/boundaries in the Pacific. The boundaries of fishing areas could be modified and adjusted according to new requirements, but it is inadvisable to introduce too frequent amendments to the already established areas. Revisions to boundaries should only be introduced after consultation with all the national fishery authorities and fishery agencies concerned with the areas under revision. Unless there are other over-riding reasons, boundaries lines should be drawn along 5° lines of longitude and latitude.

Management of the marine environment in Australia's Exclusive Economic Zone is addressed by an Oceans Policy that was put forward by the government in 1998. The policy is being implemented through Regional Marine Plans, including the development of a network of representative Marine Protected Areas. The southeast region of Australia has been the first part of the Exclusive Economic Zone to undergo regional marine planning (in 2003) and Marine Protected Area development processes are currently in progress.
