Clearing Instruments Conditions (areas subject to conditions under a clearing permit) for Western Australia are derived from authorisations and other instruments relating to Clearing of Native Vegetation under the Environmental Protection Act 1986. Data is captured by the Department of Water and Environmental Regulation and other agencies under delegated authority. Data captured represents the land clearing areas where conditions may apply. Data is captured to the accuracy required by the request. The request can be captured directly from within the Clearing Permit System application (freeform shape) using image based maps as a background for simple requests or by importing a shape file when the request is complex.

Environmentally Sensitive Areas as declared in Environmental Protection (Environmentally Sensitive Areas) Notice 2005, Government Gazette No. 55. This dataset is provided to assist landowners and managers in determining the location of environmentally sensitive areas under the Environmental Protection Act 1986. It is not a substitute for any requirement of the legislation. Those seeking further information should contact the data custodian. The ESA data was originally produced by Department of Water (D0W), completed at 30/05/2005. Department of Environment and Conservation (DEC) produced a new ESA data set to amend errors in the ESA data set. The custodian of the Environmentally Sensitive Areas dataset is now the Department of Water and Environmental Regulation. For further information contact Clearing Regulation Branch (08) 9333 7510. The "Clearing Control Catchments - CAWSA" dataset relates to Country Areas Water Supply Act 1947 (CAWSA) Part IIA Control of Catchment Areas legislation for controlling the clearing of native vegetation to prevent salinisation of water resources in some existing or potential water source catchments. The dataset is used by the Department of Water and Environmental Regulation in administering clearing licence applications, policy decision making and for providing advice. The catchments depicted were proclaimed 1976-1978 and became subject to clearing controls where land owners and occupiers could not clear native vegetation on their property unless authorised under a CAWSA Licence to Clear. The "Clearing Control Catchments - CAWSA" dataset also shows Zones of salinity risk in the controlled catchments where Zone A is the highest salinity risk and Zone D the lowest. These zones were used to determine where, in the administration of clearing controls, some limited clearing may be granted in areas of lower salinity risk. Since the advent of Environmental Protection Act 1986 (EP Act) clearing regulations in 2004, native vegetation clearing proponents state-wide must obtain an EP Act Permit before undertaking any clearing. Landowners and occupiers of CAWSA compensated land and those exempt from the need for an EP Act clearing Permit are however still required to obtain a CAWSA Licence to Clear. This data represents the Environmental Protection Authority of Western Australia. This dataset represents the spatial boundaries of the SEP Cockburn Protection Levels. The dataset was updated in 2010 to accurately represent the coastline and the recent approval of James Point Stage1. When this dataset was created schedules 1-3 of the policy were updated. There are three levels of ecological protection high, moderate and low and the policy states that the percentage of Moderate protection which is Low ecological protection should not exceed 5%. This spatial data is representative of the Office of the EPA’s most recent recalculations of this statistic. Currently the percentage of MEPA which is LEPA is 4.39%. © Government of Western Australia 2014. Environmental Protection Authority.
